The Collector Thane was asked to enquire into the
complaint of destruction of mangroves at Jesal
Park near Creek, Bhayander. The Collector, Thane
has submitted his enquiry report on 30.10.2007 in
which he has sated that an enquiry has been made
through the Tahsildar Thane. During the enquiry it
was reveled that destruction of mangrove trees,
near Jesal Park and surrounding areas of Water
Purification Plant of Mira Bhyander Municipal
Corporation, did not found.
As regards the complaint of destruction of
mangroves near Shakti Nagar, Dahisar (E)
Mumbai, the Collector, M.S.D. has submitted his
enquiry report on 26.10.2007 in which he has
stated that an enquiry has been made into the
complaint through Tahsildar Borivali, Tahsildar
Borivali along with Smt. Rupali Raghavan visited
the site in question on 18.10.2007 when destruction
of mangroves of any kind opp. Saraswati CHS did
not found. Smt. Raghavan told to Tahsildar Borivali
that someone is complaining on telephone about
the destruction of mangroves.

Environment Protection Act, 1986 with Uran Police
Station against Shri. Sashidhar Nayar Officer of the
Reliance Industry for alleged earth filling thereby
blocking the water ways causing damage to the
mangroves. Now the blockages caused by earth
filling have been removed and the natural water
ways leading towards mangroves have been freed.

B) Tahsildar Ratnagiri conducted an suo moto
enquiry, after getting knowledge of the news
cutting published in the Daily Punys Nagari,

Mohammed Bhatkar of village Karla, Tal.
Ratnagiri caused destruction to mangroves by
filling of earth in the land bearing S. No. 8 /3. An
offence bearing No. 59/ 2007 dt. 20.12.2007 has
been registered against Shri. Bhatkar with
Ratnagiri Police Station u/s 15 of the
Environmental Protection Act, 1986.
C) After getting knowledge that some persons are
cutting mangrove trees in the land bearing S.
No. 121 of village Eksar, Tal. Borivali belonging
to Shri. Narayan Daji Samant for constructing
Kaccha huts, Talathi Eksar registered an
offence bearing No. 2239/ 07 dtd. 17.12.2007

used for Monitory Station. Some people are
engaged in preparation of Cement Blocks on the
spot which is beyond 50 meters of Mangrove trees.
The workers have been asked to stop any further
activity. Destruction of mangroves was not found on
the spot.

Mumbai. Enquiry revealed that destruction of
mangroves due to filling did not take place on the

images of the spot.

office on 4th May, 2009, in which he has stated
that the Revenue Officers along with the Talathis
Mahul, Chembur and Turbhe has made joint
inspection at village Mandala, Taluka Kurla,
Survey ; No. 80, CTS No. 6 / 1 on 17.3.2009. It
is noticed that unauthorized earth filling has
been done in the creek by an unknown person.
Accordingly, FIR has been lodge at Trombay
Police Station, under section 15 (1) of the
Environment Protection Act 1996 against the
unknown person.
B) As per report letter dated 8.4.2009, received
from Collector, Raigad, on receipt of an email
from Shri. Manish, the Collector, Raigad got the
matter enquired. According to the said report at
village Dighode - Borkhar the Khar land
department was doing the work of boundary at
the site by using the JCB machine. While doing
so the destruction of Mangroves has been
caused on both side of the bund.
Accordingly Circle officer, Koproli, Taluks, Uran
has registered an offence bearing No. - FIRII/
11/2009, dated 17.1.2009 at Uran Police
Station, against the unknown person.

constructing temporary structures. Also dumping of
rabid was found on the spot. Dumping of rabid was
found to have been carried out in the night.
The temporary structures constructed on the land
have been removed by the Encroachment Deptt.
And forest Deptt. On 3.12.2009. However, during
the visit on 19.12.2009 it was found that again
structures on the said land have been constructed.
Action is being taken to remove these structures.
Further report on the progress in the matter will be
submitted in the next Monthly Report. It is also
submitted that the area in question has been
declared as Protected Forest and the same has
been already handed over to the Forest Deptt. And
primarily it is the responsibility of Forest
Department to take necessary action for protection
of mangroves on the area.

During the course of re-enquiry through the
Revenue Officers it was found that one Shri. Satish
Pujari was responsible for destruction of
mangroves on account of construction of an illegal
structure in S. No. 17 along the Mumbra creek. An
offence bearing No. 129 / 09 dtd. 10.9.2009 with
Kalwa Police Station against Shri. Satish Pujari
under the Environmental Protection Act. As regards
the present complaint, destruction of mangroves
was not found at the place.

Borivali. The site mentioned in the complaint is S.
No. 344 of village Dahisar owned by Smt.
Narmadabai Bhagawatilal Kamathia & Smt.
Krishnadevi Malchand Kamathia & others 5. At the
time of inspection, it was found that destruction of
mangrove trees had taken place in near about 2-3
acres of land. An offence with MHB Police Station
bearing No. 272/10 dtd. 5.2.2010 has been
registered against the land owner Smt. Kamathia.
Another destruction was also found to have taken
place in the said area owned by Smt. Kamathia
near ‘Sea Breeze’ building. Since the land is
marshy, the inspection party could not inspect the
site. But destruction was found to have taken place
within one acre of land. An offence with MHB Police
Station bearing No. 307/10 dtd. 10.2.2010 has
been registered for the same against the land

M/s. Shirke Construction Technology Pvt. Ltd. on
lease by the MHADA for construction of houses
under Shivshahi Project. Out of these, the houses

declared as protected forest and the land has been
transferred to the Forest Department, the Tahsildar,
Kurla has written to the Forest Department to take

truck owners and their labourers were engaged in
unauthorized extraction of earth and filling the
same in the Govt. land bearing S. No. 15 and
private land belonging to them bearing S. No. 82/4,
81/1, 81/1b, 69/3, 50,51/3, 52/2,67/1, 81/2, 68/2,
69/81/6 of village Navghar, Tal & Dist. Thane
thereby causing destruction to the mangrove trees
standing in the land. An offence has been
registered with Mira Road Police Station bearing
No. II 12/2010 dtd. 10.2./2010 against 120 persons
(Land owner /Developer/Truck Owners & Drivers)
u/s 15 & 19 of the Environment Protection Act,
1986.
An offence with Kashimira Police Station bearing
No. II 16/2010 dtd. 10.2.2010 under the
Environment Protection Act, 1986 has also been
registered against Shri. Kisanlal Madanlal Purohit
for unauthorized extraction of earth & dumping the
same thereby causing destruction to the mangrove
trees standing in the land bearing S. No. 229/1 of
village Ghodbunder, Tal. & Dist. Thane. Two JCB’s
have been attached and handed over to Kashimira
Police Station during the course of enquiry.
Enquiry conducted by Circle Officer, Mumbra
revealed that Shri. Rohidas Laxman Mhatre, Sanjay
Krishna Mharre, Ananta Ambo Mhatre, Sitaram
Shankar Kene, bharat Krishna Alimkar & Ratan
Divdya Foujdar have unauthorisedly done earth
filling in S. No. 1 to 35 of village Domkhar, Tal. &
Dist. Thane near the creek thereby causing
damage to the mangrove trees. It was also found
that the above persons have felled the mangrove
trees. An offence with Daighar Police Station
bearing No. II 13/2010 dtd. 27.1.2010 has been
registered against the above mentioned persons.

Nahur (East) Mumbai.
Collector, Mumbai Suburban District has submitted
enquiry report dt. 4.8.2010, wherein it has been
stated that the Circle Officer, Ghatkopar and
Talathi- Nahur visited site with the complainants –
Mrs. Meghna Dawer and Dr. Amol on 29.3.2010.
On survey, it was found that the work of drain
widening was being done under the BRIMSTOWAD
Project-2. The contract for the widening of the drain
was given to M/s. Shekon Chirag Construction
Company by the Municipal Corporation of Greater
Mumbai. Due to the ongoing work it was possible
that mangroves area in the vicinity of the drain
might have been affected. As per the PIL No. 87/
2006 filed by the Bombay Environmental Action
Group regarding 13 such drains in the Mumbai
Suburban District, the drain in question being one
of them, it was directed by the Honorable High
Court that the work such drains especially under
the BRIMSTOWAD project can be done after taking
permission from itself and other competent
authorities. The Honorable High Court has given
permission to the Municipal Corporation for the
repair of the drain but after taking the permission
from the other competent authorities as well. The
Company has now applied for the same from the
Forest Department.
It was seen that the Company was doing the work
of concretization and leveling of the drain – till 200
m on the North side and upto 100 m on the South
side. It was seen that the mangroves are at a
distance of 275 m from the construction site.
It was also reported that any destruction of
mangroves has not been found at the spot.

his enquiry report in which it is stated that the Sub
Divisional Officer, MSD along with the Revenue
Officers and the complainant namely Shri
Ghosalkar, MLA, Shri Prakash Surve. At the time of
site inspection it was found that the land owner of
S. No. 344 pt. of Village Dahisar, Tal. Borivali Smt.
Krishnadevi Bhalchandra Kamathia had caused
destruction to the mangrove trees at a distance of
300 m, from Sea Breeze Building by filling 2-3
truckload debris on the banks. In the same land,
destruction has been found at 4-5 places in all
directions with several truckload of debris thereby
stopping natural flow of creek water to the
mangrove trees. During the month of January &
February 2010, two offences have been registered
against the landowner Smt. Kamathia. This matter
has been reported in the 53rd Monthly Report
submitted to the Hon. High Court. Fresh two

landlord used to cultivate paddy. Here there could
not have been any mangroves in this land.

said site are not mangroves but those of lady finger

Govt. Accordingly Tahsildar Borivali through a letter
dated 31.1.2011 has been informed the Engineer

Maritime Services Pvt. Ltd. which was considered
illegal as it was on land under the CRZ-III. Hence
PNP Pvt. Ltd. was fined Rs. 5,63,878 and Rs.
5,00,000 respectively which has already been paid
by the Company.
The mangroves near Dharamtar creek were found
to be damaged and a FIR bearing the No. 8/05 dt.
10.3.2005 has been registered against unknown
persons with the Poinad Police Station.

was done by Residential Naib Tahsildar Borivali
along with Circle Officer, Borivali, Talathi Eksar,
Talathi Borivali & representatives of Bombay
Environmental Action Group and New Link
Residents Forum.
During the inspection it was seen that on
approximately 5 acres of the said site. (S. No. 209
Area 10.29.1 acre), there is inflow of creek water
and there are mangroves in this area. The
remaining part of the land has been encroached
upon by putting of tin walls. On enquiry it was found
that the land in possession of the family of Shri
Nitin Parshuram Vichare. The case about
encroachment filed by the MCGM is still pending in
the City Civil Court.
It was observed that rabbit and mud had been
dumped in this land and also a cattle shed has
been constructed on this encroached land due to
which an offence bearing No. 1298 has been filed
with MHB Police Station under section 15(1)(2) of
the Environmental Protection Act, 1986.

inspected and it was found that Sant Nirankari
mandal had encroached upon the Government
land. Deputy Collector (Encroachment), Malad has
been directed to remove this encroachment. At the
same spot 2 trucks were seen dumping debris for
leveling. These trucks have been confiscated and
an offence bearing No. 64/ 2010 had been
registered with Malvani Police Station on 8.9.2010.

Additional Collector (Encroachment) & Chief
Controller Illegal Constructions, CIDCO has
submitted an enquiry report dt. 28.09.2011 in which
it has been specified that Beat Officer of that region
has carried out a visual survey of the said site
where it was seen that waste materials had been
dumped by the residents at the site. The material
appears to be waste from the repairs of the houses
undertaken by the residents in that area. The
concerned section has been ordered to clean up
the area by CIDCO.

Balkum that as of today there is no destruction
of mangroves happening at the said site.

Collector, Raigad has enquired into the matter and
has submitted an enquiry report dt. 3.10.2011 in
which it has been specified that as per the
complaints regarding mangroves being destroyed
in Khopte village in Uran taluka by Continental
Warehousing Co. at Vahal village, Taluka Panvel
by Reliance SEZ and at Ulve Creek in Panvel, a
visual inspection of the above sites was carried out
by the Dy. Commissioner (Revenue), Konkan
Division, Tahsildar Uran and Tahsildar Panvel
along with Shri Chavan who had filed the
complaint. Some of the senior as well as the
respected villagers were also present at the site at
Khopte during the inspection. it was seen that no
damage was caused to the mangroves at the site at
Khopte Village.
At the site at Vahal village, a compound wall is
being constructed by Reliance SEZ. It was seen
that there were a few mangrove plants within 50
mtrs of the wall being constructed. However it was
told and was also given in writing to the officers
conducting the inspection that the plants in
question were merely two years old and had grown
there after the construction of the wall had started.
At Ulwe creek it was seen that the site has been
used as a sand depot for many years and hence
there were no mangroves at the said site.
At Harihareshwar and Bagmandle, Taluka
Srivardhan, offences have been registered against
the following persons for violation of the Hon’ble
High Court’s order and carrying out construction
activities within 50 mtrs of and causing damage to
the mangroves under article 15 of the
Environmental Protection Act, 1986.

done by Shri Patil. Accordingly an FIR bearing No.
1134/2011 has been registered with the MHB
